Appeal support and expert witness services

We provide appeal support and expert witness services where transport matters are central to the determination of a planning application.

Our role is to present clear and robust evidence, grounded in policy and guidance, and explained in a way that can be readily understood by Inspectors and decision-makers. We work closely with legal teams and project stakeholders to ensure transport issues are addressed thoroughly and proportionately.

In England, planning appeals are administered by the Planning Inspectorate (PINS), with Welsh appeals determined by Planning and Environment Decisions Wales (PEDW). We are familiar with all three procedures used at appeal: Written Representations, Hearings and Public Inquiries, and tailor our approach to suit the case and the procedural route. Where Apex acts as an expert witness, we work in accordance with the RTPI and CIHT practice advice on acting as an expert witness and recognise our overriding duty, presenting evidence that is impartial, technically robust and independent of the parties’ commercial positions.

Our experience allows us to focus on the points that genuinely influence outcomes, supporting a clear and credible case at appeal.

FEATURED PROJECT

Farleigh Fields West, Backwell

Apex provided highways and transport consultancy support for a proposed residential development of 125 homes at Farleigh Fields West, Backwell. The project progressed to a Public Inquiry, where Apex acted as expert witness for highways and transport matters.

Our role included preparing a comprehensive Transport Assessment and Travel Plan for the planning application and a detailed Proof of Evidence for the appeal, addressing the full range of highways, access, sustainability and network capacity issues raised during the planning process.

Apex provided transport planning and highways advice to support an outline planning application for the Cardiff Peninsula development, a major mixed-use waterfront regeneration scheme.

The proposals comprise approximately 1,000 residential apartments, 300 co-living units, 11 townhouses, a 220-bed hotel, around 30,000 sqm of employment space, alongside retail, food and drink, community and leisure uses. The proposed masterplan will create a new and vibrant waterfront development for the community to live, work, relax and visit.

Apex prepared a Transport Assessment and Framework Travel Plan to support the application, with a particular focus on sustainable connectivity, active travel and reducing reliance on the private car.

Cardiff Peninsula
